These terms and conditions outline the rules and regulations for the use of the Hazel Website, located in hazelportugal.com.

1. Scope and Object of the General Conditions of the Store

These General Conditions are intended, with the order form, and the other elements referred to therein, to regulate the terms and conditions governing the availability of the Hazel Shop.

The Service consists of providing access to the Online Store at the hazelportugal.com which, in addition to providing information about a set of products, allows the User, electronically, to order the products disclosed therein, in the terms and conditions described herein.

The order of products must be made by Users aged 18 (eighteen) years or older. The elements and information transmitted by the User will benefit from full legal effects, the User recognizing electronic purchases, and the User may not claim the lack of signature for non-compliance with the obligations assumed.

2. Information on Products and Content

Hazel will do everything possible to make sure that the information presented does not contain typographical errors, and will be quickly corrected whenever they occur. If you purchase a product with characteristics other than those presented online, you have the right to terminate the purchase agreement under applicable legal terms (right of free replay).

Hazel will do its utmost to ship all ordered products, but it is possible that in certain cases and due to causes difficult to control by Hazel, such as human errors or incidents on computer systems, it is not possible to provide any of the products requested by the User. If any product is not available after the order is edited, you will be notified by email or by phone. At that time, you will be presented with the possibility to cancel the order with its refund if you have already made the payment.

All information about prices, products, specifications, promotional actions and services may be changed at any time by Hazel.

3. Responsibilities

3.1 All products and services sold in the Hazel Online Store are in accordance with Portuguese law.

3.2 The Store has adequate security levels, however Hazel will not be liable for any losses suffered by you and/or third parties, due to delays, interruptions, errors and suspensions of communications arising from factors outside its control, including any deficiencies or failures caused by the communications network or communications services provided by third parties, the computer system, modems, software connection or any computer viruses or resulting from downloading (“download”) through files infected or containing viruses or other properties that may affect the User’s equipment. If, for any reason of error in accessing the online store website, hazelportugal.com that it is impossible to provide a service, Hazel will not be liable for any losses.

3.3 The data and information queries conducted under this Service are presumed to have been conducted by you, and Hazel disclaims any liability arising from the misuse or fraudulent use of the information obtained.

3.4 Hazel shall not be liable for any loss or damage caused by misuse of the Service that is not directly attributable to it as fraud or serious fault.

3.5 Hazel is not liable for loss or damage resulting from non-compliance or defective performance of the Service when it is not directly or indirectly attributable to it by serious intent or fault, and is not liable in particular for

(i) errors, omissions or other inaccuracies relating to the information made available through the Service;

(ii) damages caused by the fault of the User or third parties, including intellectual property violations,

(iii) for non-compliance or defective conformity resulting from compliance with judicial decisions or administrative authorities or

(iv) with regard to non-compliance or defective conformity resulting in situations of force-greater force, that is, situations of an extraordinary or unpredictable nature, outside hazel and which cannot be controlled by hazel, such as fires, power cuts, explosions, wars, riots, civil insurrections, government decisions, strikes, earthquakes, floods or other natural situations of cats or other situations not controllable by Hazel that prevent or prevent the fulfillment of obligations assumed.

3.6 Hazel does not guarantee that:

3.6.1 the Service is provided uninterruptedly, is secure, error-free or works infinitely;

3.6.2 The quality of any product, service, information or any other material acquired or obtained through the Service meets any expectations of the User in relation thereto;

3.6.3 Any material obtained in any way through the use of the Service is used at your own risk and risk, being solely responsible for any damage caused to your computer system and equipment or for any loss of data resulting from such operation.

3.6.4 No oral or written advice or information obtained by the User from or through the Service will create any warranty that is not expressed in these General Conditions.

4. Consumer obligations

4.1 The user undertakes to:

4.1.3 Respect the order limits imposed.

5. Service Safety Conditions

5.1 The User undertakes to comply with all applicable legal provisions, in particular, not to practice or encourage the practice of unlawful or offensive acts of good customs, such as the indiscriminate sending of unsolicited communications (junk mail) in violation of the legal provisions applicable to the processing of personal data and advertising communications through automatic calling devices, and must also comply with the rules for the use of the Service Service , and must also comply with the rules for the use of the E-Mail Service. , under penalty of Hazel suspending or disabling the Service as set out in point 13.

5.3 Hazel also does not guarantee the provision of the Service in situations of unforeseeable overload of the systems in which it is supported or of force-greater force (situations of an extraordinary or unpredictable nature, outside of Hazel and which cannot be controlled).

5.4 In the event of an interruption in the provision of the Service due to an unpredictable overload of the systems on which it is supported, Hazel undertakes to regularise its operation as soon as possible.

6. Suspension and deactivation of the Service

6.1 Regardless of any prior or subsequent communication, Hazel may, at any time and in its sole discretion, suspend the provision of the Service and/or part of the Service to one or all Users.

6.2 Hazel also reserves the right to immediately suspend or terminate access to the Service in the following cases:

6.2.1 When the User does not comply with the conditions of use referred to in point 4 and others referred to in the General Conditions;

6.2.2 When Hazel no longer accesses the Store, giving 15 days in advance of the termination date.

7. Communications

7.1 Without prejudice to other forms of communication provided for in these General Conditions, notifications made to you related to the Service, including any changes to these General Conditions, may be sent to your email address by SMS or contact telephone.

7.2 You agree to receive any communication and/or notification related to the Online Store, address, contact phone number and/or email address indicated in the order process.

7.3 At any time, you may request not to receive these communications and/or notifications through the Contact Form or through the “Do not receive newsletter” option registered in each Newsletter.

8. Technical definitions

8.1 Without prejudice to the provisions of the following paragraph, Hazel may amend the Service and/or the technical conditions to provide it, as well as its rules of use, and shall disclose to the User such changes at least 15 (fifteen days).

8.2 The version at each time in force of these General Conditions and its annexes is available on the www.hazelportugal.com

9. Links

9.1 Where Hazel deems it necessary or convenient to optimise the browsing experience and/or improve connectivity conditions, it may remotely reformulate network settings.

9.2 Without prejudice to the provisions of the following issues, and taking into account the innovative nature of the Service and the technological developments to which it may be subject, Hazel may change its technical settings where it proves appropriate to adapt it to any technological developments.

9.3 Hazel does not, however, warrant to you any updates or improvements to the Service.

9.4 Some updates or new features of the Service may only be available against payment by you and/or your subscription to Specific Conditions of Use.

10. Taxes and fees

10.1 Depending on your delivery address, different taxation rules and additional fees may apply. If hazelportugal.com is outside your territory, you may need to pay import fees at the reception of the products. If not included, Hazel will have no control over these charges and we cannot provide information on the amount. You will be responsible for paying any import fees and taxes not included. Please contact your local customs for more information and a “final cost estimate” before making your order.
10.2 For U.S. customers, Hazel does not collect sales or use taxes in all states. Hazel does not charge use tax for international purchases. For states that impose sales or use tax, your purchase may be subject to use tax unless specifically exempt from taxation. Many states require customers to file a sales/use tax return at the end of the year informing all taxable purchases that have not been taxed and that pay taxes on those purchases. Please be aware that US customs may request your IRS, EIN or SSN number before allowing delivery to your address. You will normally have one week to provide this information before your order is returned to Hazel for a refund.
10.3 Please note that if you return an item, taxes and import duties will be refunded only if they were originally included in the purchase price. If they were not included, you will be responsible for recovering taxes directly from the local Customs.

11. Complaints

11.1 The User may submit any contractual disputes to arbitration and mediation mechanisms that are or will be legally constituted, as well as complain to Hazel about acts and omissions that violate the legal provisions applicable to the acquisition of assets.

11.2 The complaint must be submitted within a maximum of thirty (30) days, counted from the knowledge of the facts by the User, being registered in the information systems of Hazel, who must decide the complaint and notify the interested party within a maximum period of thirty (30) days from the date of receipt.

Applicable law

The Contract is governed by Portuguese law.
